1940. Incident around the flag during World War II:
The Germans, who had just monopolized a part of France, including Paris, were
went to the castle of the Haitian minister, Mr. L.R. Thébeau, and one of their soldiers
pulled up the Haitian flag attached to the balcony railing and threw it to the ground; and this, despite
the exhortation of the castle guard who had made him understand that the flag
represented a country. “Here is the captain of the Cavalry, Count Von Einsuedel
[it] picked up... handed it to the Minister, who handed it over to the guard so that it could be handed over to his
place... The officers present [him] then paid military honours".
1990. Assassination of Serge Villard, a member of the Council of State in 1990:
This assassination took place at a time when the sector linked to the former Duvalier regime
(1957-1986) who had never disarmed or resigned to no longer lead the games
political, intensified its criticism of the Council of State, which was part
Serge Villard. The latter had been a member of the 1987 Constituent Assembly and
was perceived as the father of Article 291 of the March 1987 Constitution which
prohibited people closely associated with the Duvalier dictatorship
to hold elected office for 10 years from the publication of the
Charter.
2020. Decree of President Jovenel Moise announcing the publication of a new
Penal Code:
This decree was issued in the absence of a functional Parliament and in a context of
social and economic crisis raised many questions and protests.
Voices, including that of the Episcopal Conference of Haiti, of the Federation
Protestant of Haiti, accused the government of wanting to decriminalize
attitudes and wrongful acts or actions contrary to Haitian culture. Of
jurists there detect, in its content, the French Penal Code.
This decree, which will come into force in 24 months, if the government persists in
wanting to impose it, will replace the Code of August 11, 1835, in force
